Lola Wireless Communications and Consulting (“LWCC”) Terms of Service Policy

Lola Wireless Communications and Consulting, Inc. has prepared this Terms of Service Policy (“Policy”) as a guide for its customers to understand the intended and permissible uses of our service(s), and to prevent exploitation, fraud, and abuse of its service(s), unlimited calling plans and features.

  1. Normal and Reasonable Use

LWCC. residential unlimited service plans and features are only for normal residential or personal, non-commercial/business use. This means that only the account holder, residential family members registered may use LWCC residential unlimited service plans. Residential family members include your immediate family who reside in your personal residence – e.g., spouse, domestic partner, parents and/or children.

  1. Impermissible Use(s)

We evaluates our customer usage in comparison to similarly situated customers. Each of the following is considered outside of normal residential or personal, non-commercial use, and is considered a violation of out TOS agreement.:

  • use by or for others who do not live at the registered address.
  • operating a business, even if operating from the residence address
  • operating any other enterprise, including not-for-profit organization
  • operating a call center
  • resale to other consumers
  • auto-dialing or mass faxing
  • telemarketing
  • use without live dialog, including use as live monitor, intercom, transcription purposes or where a constant live link is required

Because most LWCC residential unlimited calling plan customers use less than 2500 minutes per month and do not have any unusual usage patterns, a customer’s aggregate usage may be considered outside of normal use if it exceeds 2500 minutes per month, also in  combination with one or more of the following, including, but not limited to, excessive:

  • amount of unique numbers dialed
  • call times
  • amount of time in-between calls
  • conference calling
  • short calls

Based on above stated combination, LWCC may determine that abnormal, unreasonable or impermissible usage is occurring, and may take necessary steps to enforce this Policy and the Terms of Service

  1. Refund, exchange and cancellation.

Customer/Subscriber agrees to pay all applicable fees for LWCC Services in effect at the time of sign-up registration and/or renewal. Customer/Subscriber agrees to update and keep current all of the billing information, email and all other contact information. It is the Subscriber’s responsibility to verify that the information submitted is accurate to insure proper billing and continued services.

As a courtesy and not as an obligation (unless otherwise requested), fourteen (14) days prior to the expiration of Subscriber’s Account or Domain(s) LWCC will automatically renew Subscriber’s Account by charging the applicable fee for the non-promotional rate to Subscriber’s current method of payment on file. The initial term of this Agreement shall be as set forth during the initial purchase or registration process. The Initial Term shall begin upon commencement of the Services to Subscriber, and after the Initial Term, this Agreement shall continue for successive periods (or renewal period) of equal length as the Initial Term or such other Term and price that shall be set forth in a notice to the customer at least thirty (30) days prior to the commencement of such successive period or renewal period. Thank you for reading LWCC Terms of Service Policy. Since you have read this far, please contact us to receive one USD$5.00 credit on your next invoice. Limit one per customer per account. The Terms and Conditions will now continue. In the case of insufficient funds we will attempt to collect at a partial term quantity (not changing your current term) to continue service as per agreement. Additionally after the Initial Term, you acknowledge, agree and authorize LWCC to automatically bill and/or charge on your credit card, PayPal, E-Check or other established form of payment for successive or renewal periods, unless terminated or cancelled by either party as provided in this section. LWCC shall provide notice of the upcoming charge to Subscriber no later than thirty (30) days prior to the payment date. The Initial Term and all successive renewal periods shall be referred to, collectively, as the “Term”.

Customer/Subscriber will be notified of pricing for EACH successive period (or renewal period) no later than thirty (30) days prior to the payment date of SUCH successive period (or renewal period) for all products and services with a successive or renewal period of twelve (12) months or greater. This notification will be sent to the contact email address on file for the account.

In the event Subscriber issues a chargeback or reversal of charges without first following the below cancellation procedures, the Subscriber will be responsible for a USD$25.00 billing service fee. Accounts that have an open dispute may be disabled for security purposes.

In the event Subscriber cancels the Services within three (3) calendar days of registration, Subscriber will receive a full refund of all fees paid in connection with the service, with the exception of any Nonrefundable Fees which will be clearly indicated during the setup and/or order process.

Subscriber agrees to direct all cancellation requests to LWCC via user portal, phone, in person or mail. The cancellation request must include verification of ownership of the account. Subscriber must also confirm to LWCC that all emails, files, and databases are preserved, backed up and moved away from LWCC equipment and/or servers.

 

By agreeing to Lola Wireless Terms of Service customer also agrees to Privacy Policy (“Policy”) and E911 Notice
